These Terms and Conditions (“Terms”), together with your booking confirmation email (the “Booking Confirmation”), set out the legal terms on which Travel Services are made available to you. They also cover any interactions or communications you have with us.
Your use of our Service is conditioned upon your acceptance of these Terms. To book a Travel Service, you must also accept these Terms. If you do not accept these Terms, please do not use our Service or book a Travel Service.
We may change these Terms at any time. Your future use of our Service following changes to these Terms is subject to you accepting those updated Terms. We recommend that you save or print a copy of these Terms.
In these Terms:
• “we”, “us” or “our” refer to Pioneer Valley Travel Inc, a corporation having its office at 88 King Street, Northampton, MA 01060.
• “our service” refers to the provision of travel advisory and booking services to you.
• “Travel Services” refers to the travel services made available to you by the relevant Travel Provider(s) through our Service (such as stays at a property, flights, car rentals, cruises, transfers, insurance, or activities).
• “Travel Provider” refers to the travel supplier making available the Travel Services to you through our Service.
• “you” refers to you, the traveler, using our service or making a booking through our Service.
1. Rules and Restrictions
As well as these Terms, other terms and conditions provided by Travel Providers (such as airline conditions of carriage, property or cruise line terms, or car rental agreements) also apply to your booking (“Rules and Restrictions”).
We act only as an agent. To make a booking, you must accept the Rules and Restrictions of the Travel Provider you select (such as payment terms, refundability, penalties, and availability restrictions).
The relevant Rules and Restrictions are provided before you make a booking and are incorporated by reference into these Terms.
If you violate a Travel Provider’s Rules and Restrictions:
• Your booking may be canceled.
• You may be denied access to the relevant Travel Service.
• You may lose any money paid for such booking.
• We or the Travel Provider may charge your account for any costs incurred due to such violation.
2. Using Our Service
Our Rules
We provide our Service to help you find information about Travel Services and assist in booking them. You agree that:
• You must be at least 18 years of age and have the legal authority to enter into contracts.
• You will use our Service lawfully and in compliance with these Terms.
• All information supplied by you is true, accurate, current, and complete.
If you book on behalf of others:
• You will obtain their authorization prior to acting on their behalf.
• You will inform them of all terms that apply to the booking (including the Rules and Restrictions) and ensure they agree.
• You are responsible for paying any amounts due, making any changes/cancellations, and all other booking matters.
You also agree not to:
• Make any false or fraudulent booking.
• Access, monitor, or copy any content on our Service using any automated or manual process.
• Violate the restrictions in any robot exclusion headers on our Service.
• Deep-link to any part of our Service or “frame” or “mirror” any part of it into another website.
Access
We may deny anyone access to our Service at any time for any valid reason. We may also make improvements or changes to our Service at any time.
Redirection and Third-Party Booking Services
If you are redirected from our Service to a third-party booking service, your booking will be with that third party, not us. We are not responsible for bookings made through third parties.
Our Service may also contain links to websites operated by others. Such links are provided for reference only, and we are not responsible for their content or use. Inclusion of such links does not imply endorsement.
3. Confirming a Booking
Your Booking Confirmation includes essential details such as the Travel Service(s) booked and the price.
We will send your Booking Confirmation and relevant travel documents to the email address provided at booking.
If you do not receive your Booking Confirmation within 24 hours, please contact us.
4. Payment
Price
• The price of the Travel Service(s) will be as displayed on our Service, except in cases of obvious error.
• Prices for Travel Services are dynamic and can change at any time.
• We reserve the right to correct any pricing errors.
If there is an obvious error after booking, we may:
• Offer you the opportunity to keep your booking by paying the correct price, or
• Cancel your booking without penalty.
We have no obligation to make available Travel Services at an incorrect (lower) price if the error was apparent.
Local Taxes and Resort Fees
• Displayed prices may exclude local or tourist taxes and resort fees.
• In some jurisdictions, these may need to be paid directly to the Travel Provider on arrival or departure.
Payment Processing
• For certain Travel Services, payment may be charged directly by the Travel Provider and others by us.
• Our Privacy Statement explains how we use and store payment information.
Bank and Currency Fees
• Some banks and card issuers impose international or cross-border transaction or conversion fees.
• We are not responsible for any such fees or exchange rate variations.
Alternative Payment Methods
• We may partner with alternative payment providers but do not endorse or take responsibility for them.
• Use of such payment methods is at your own risk and subject to their terms.
Fraud
If a booking or account shows signs of fraud or suspicious activity, we may:
• Request additional information.
• Cancel any associated bookings.
• Close related accounts.
• Take legal action if necessary.
5. Cancelling or Changing a Booking
Cancellation or Change by You
• Cancellations or changes can be made by contacting us.
• You do not have an automatic right to cancel or change unless allowed by the Travel Provider.
• Fees may apply as set out in the relevant Rules and Restrictions.
Please note:
• Prices for new arrangements may differ from the original booking.
• Some Travel Providers do not permit cancellations or changes after booking.
• Refunds depend on the Rules and Restrictions.
We may also charge an administration fee for handling cancellations or changes, which will be disclosed before proceeding.
Other Cancellations or Changes
If full payment or applicable fees are not received when due, we (or the Travel Provider) may cancel your booking.
In cases such as property overbooking or closure, we will notify you and offer alternatives or a refund.
Refunds
Refunds will be made to the original payment method by the party that took your payment. Our service fees are non-refundable unless otherwise stated.
6. International Travel
Travel Risks
Travel to certain destinations may involve more risk. You must review government travel advisories before and during your trip.
Health
You are responsible for:
• Meeting all health entry requirements.
• Obtaining required vaccinations and medications.
• Following medical advice for your travel.
Passport and Visa
You must consult the relevant Embassy or Consulate for passport and visa information before booking and departure. We are not liable if you are refused entry due to missing documents or noncompliance.
Insurance
Travel insurance is not included unless stated. You are advised to obtain appropriate insurance to cover cancellations, accidents, or illness.
7. Liability
Our Liability
We own and operate our Service, but Travel Providers supply the Travel Services.
We are not liable for:
• The acts, errors, or negligence of Travel Providers.
• Any injury, death, property damage, or expenses resulting from Travel Services.
• Inaccuracies in information provided by Travel Providers.
We make no guarantees about availability, and photos or descriptions are for guidance only.
Limitations
To the maximum extent permitted by law:
• All information and Travel Services are provided without warranty or condition.
• We are not liable for indirect, incidental, or consequential damages.
• Our total liability shall not exceed the cost paid for the Travel Services or $100 (whichever is greater).
Indemnity
You agree to defend and indemnify us from any losses arising from:
• Your breach of these Terms.
• Your violation of laws or third-party rights.
• Your use of our Service, except where caused by our actions.
8. Privacy
We are committed to protecting your privacy and security. Please review our current Privacy Statement for details.
9. Disputes and Arbitration
Please read this section carefully — it affects your rights.
We use a two-step dispute process:
• Step 1: Investigation and negotiation by our Traveler Support team.
• Step 2: Binding arbitration administered by the American Arbitration Association (AAA).
You and we both retain the right to seek relief in small claims court.
Agreement to Arbitrate
Any dispute arising from or relating to our Service, these Terms, or Travel Services will be resolved by binding arbitration, not in court, except as allowed in small claims court.
No Class Actions
All proceedings must be conducted individually, not as a class or representative action.
Arbitration Rules
• Governed by the Federal Arbitration Act (FAA) and AAA Consumer Arbitration Rules.
• Arbitration will apply the law of Massachusetts.
Pre-Arbitration Requirement
Before arbitration, you must attempt to resolve your claim by sending a Notice of Dispute by certified mail to our office, including:
• Your name and address.
• The email used for booking.
• Description of your complaint and requested resolution.
If unresolved after 60 days, arbitration may proceed.
Arbitrator’s Decision
• The arbitrator’s decision is final and binding.
• Relief may be granted only on an individual basis.
Severability
If any part of this arbitration section is found unenforceable, the rest remains valid, except class or representative claims must proceed in civil court.
10. General
• Governing Law: These Terms are governed by the Federal Arbitration Act and the laws of Massachusetts.
• Failure to Enforce: Our failure to enforce a provision does not waive our right to enforce it later.
• Unenforceable Provisions: If any part is invalid, the rest remain effective.
• Entire Agreement: These Terms supersede all prior communications.
• Assignment: We may assign our rights under these Terms; you may not.
• Third-Party Rights: No third party has enforcement rights under these Terms.
• Survival: Any provisions intended to survive termination will remain in effect.
